Notice of Passing - Zoning Bylaw Amendment No. ZA16.2026

TAKE NOTICE that the Council of The Corporation of the Municipality of West Grey passed and enacted Bylaw No. 2026-060 on September 1, 2026, pursuant to Section 34 of the Planning Act, R.S.O. 1990, c. P.13, as amended and Ontario Regulation 545/06 for the purpose of adopting amendments to the Municipality of West Grey’s Zoning Bylaw No. 37-2006, as amended.

Council has considered all written submissions received to date and oral submissions made at the public meeting held on July 7, 2026, the effect of which helped to make an informed recommendation and decision.

PROPERTY DESCRIPTION:
The zoning bylaw amendment relates to all lands located within the Municipality of West Grey.

PURPOSE AND EFFECT:
The purpose of this application is to amend the current Municipality of West Grey Zoning Bylaw 37-2006 to permit the following:

  1. accessory apartments in all residential zone;
  2. the NE zone to be used in the calculation of lot area;
  3. development on lots having frontage on a maintained public highway via registered easement; and
  4. Builder/Contractor’s Yards in the Restricted Industrial (M2) zone.

APPEAL PROCESS:
Only the applicant, the municipal authority, specified person(s) and the Minister may appeal a decision of the municipality or planning board to the Ontario Land Tribunal (OLT). Individuals are no longer permitted to do so. If a Council decision is appealed to the OLT, you can request participant status and make written submission to the OLT for consideration as part of the decision-making process. The OLT Citizen Liaison can help you better understand the rules, practices and procedures of the OLT and can be reached by email.

No person or public body shall be added as a party to the hearing of the appeal unless, before the amendment was approved, the person or public body made oral submissions at a public meeting or written submissions to the council or, in the opinion of the Ontario Land Tribunal, there are reasonable grounds to add the person or public body as a party.

Take notice that an appeal to the Ontario Land Tribunal in respect to all or part of this Official Plan Amendment and/or Zoning Bylaw may be made by filing a notice of appeal with the Clerk either via the Ontario Land Tribunal e-file service (first-time users will need to register for a My Ontario Account) at https://olt.gov.on.ca/e-file-service by selecting Municipality of West Grey as the Approval Authority or by mail to 402813 Grey Road 4, Durham ON N0G 1R0, no later than September 22, 2026. The filing of an appeal after 4:30 p.m., in person or electronically, will be deemed to have been received the next business day. The appeal fee of $1,100 can be paid online through e-file or by certified cheque/ money order to the Minister of Finance, Province of Ontario. If you wish to appeal to the Ontario Land Tribunal (OLT) or request a fee reduction for an appeal, forms are available from the OLT website at www.olt.gov.on.ca. If the e-file portal is down, you can submit your appeal to clerk@westgrey.com.

A notice of appeal must set out the reasons for the appeal and must be accompanied by the fee required by the Ontario Land Tribunal in the form of a certified cheque or money order payable to the Minister of Finance.

The last day for filing a Notice of Appeal is 4:30 p.m. on September 22, 2026.
